About Tier II

Tier II is the second half of a chemical inventory reporting format that was created with a two-tier approach, Tier I and Tier II. Since this type of reporting was created, most all Local Emergency Planning Committees (LEPC) and State Emergency Response Commissions (SERC) have required only the second half of the chemical reporting, Tier II. All facilities with reportable chemical quantities listed under the Illinois Chemical Safety Act must comply. The Tier II must be submitted by March 1 for the previous reporting year, beginning January 1 and ending December 31.

Penalties for non-compliance

Any business which operates in violation of the Illinois Chemical Safety Act shall be liable for a civil penalty not to exceed $10,000 for each violation, and an additional civil penalty not to exceed $1,000 for each day during which such violation continues.

Reporting Agencies

There are reporting requirements within the Emergency Planning and Community Right-to-Know Act (EPCRA). Each SERC, LEPC and fire department having jurisdiction must receive information on hazardous chemicals for which the Occupational Safety and Health Administration (OSHA) requires industry to have Material Safety Data Sheet (MSDS). The LEPC is appointed by the SERC to coordinate the development of Facility Specific Emergency Response Plans as prescribed under the EPCRA. The LEPC is a committee formed from representatives of various entities in the community. The Decatur Fire Department is the authority having jurisdiction. The Illinois Emergency Management Agency (IEMA) is the SERC for the state.

Submitting the Tier II

The State of Illinois requires that each facility, that must comply, send their necessary information by electronic format using the IEMA Tier II Manager On-line Submission Program. Use this link and follow the instructions on the page.

Facilities may use the above link to access the system. Once the forms are completed, the user may print out the form before submitting. It may not be downloaded to a file. The Decatur Fire Department and the LEPC are required to each receive a hard copy of the Tier II. The copies must have an original signature and date. Once printed, signed and dated, the Tier II may be sent to the following:
